§ 8AA-70. Uniform rights-of-way ordinance.

  • (a)

    A uniform ordinance governing rights-of-way usage by telecommunications companies and cable companies enacted pursuant to the requirements of state law requiring such ordinance shall preempt and supersede the provisions of Chapter 8AA to the extent there exists a conflict between chapter 8AA and such ordinance only to the extent state law mandates the uniform treatment of telecommunications companies and cable companies regarding use of the rights-of-way.

    (b)

    In addition to or instead of any other remedy, the County may seek legal or equitable relief from any court of competent jurisdiction.

    (c)

    Failure of the County to enforce any requirements of a license or this chapter shall not constitute a waiver of the County's right to enforce subsequent violations of the same type or to seek appropriate enforcement remedies.
