This Article shall become effective (10) days after the date of enactment, unless
vetoed, and if vetoed, shall become effective only upon an override by this Board.
The Director is hereby authorized to make the necessary notations upon the maps and
records of the Miami-Dade County Department of Planning and Zoning and to issue all
permits in accordance with the terms and conditions of this article. It is provided
however that this Article shall not apply to any project or structure located within
the Downtown Kendall Urban Center District that has previously received site plan
approval through a public hearing or administrative site plan review (ASPR), yet has
not been constructed at the time of adoption of this Article. Said projects may be
constructed in accordance with the terms of its approval within the ensuing five (5)
years. Any structure that has been issued a valid building permit which is still valid
five (5) years from the date of adoption of this Article, may proceed to construction
under the terms of that permit. For the purpose of calculating the five (5) year period
under this section, the time shall be tolled during the pendency of administrative
or judicial proceedings relating to development permits or development orders.
