§ 25B-28. Environmental review.
(a)
Prior to recommending the acquisition of lands that are located on or near tidelands, submerged lands, swamp, or other wetlands, whether or not those lands have been granted in trust to a local public agency, any agency receiving funds pursuant to this article shall submit to the Miami-Dade County Department of Environmental Resources Management (DERM) any proposal for the acquisition of those lands pursuant to this measure. DFRM may, at its discretion, within ninety (90) days of such a submission, review the proposed acquisition, make a determination as to the States existing or potential interest in the lands, and report its findings to the entity making the submittal and to the County Manager.
(b)
No wetlands or riparian habitat acquired pursuant to Section 25B-22 shall be used as a dredge spoil area or shall be subject to revetment which damages the quality of the habitat for which the property was acquired.
(c)
No provision of this article shall be construed as authorizing the condemnation of publicly-owned lands.
