§ 13-16. Claims.

  • (a)

    All claims of property damage arising out of the use of explosives shall be acknowledged by the user (or the user's agent) and notification given to the Director within seven (7) days of receipt. The notification to the Director shall include the following information:

    (1)

    Date and time of the claim.

    (2)

    Name, address, and telephone number of the claimant.

    (3)

    Nature of the claim.

    (b)

    The user shall promptly process any and all property damage claims. The user is responsible to ensure that the claimed damage will be inspected within a reasonable time not to exceed thirty (30) calendar days of initial receipt of the claim and shall estimate the total amount of the damages claimed and provide the claimant and the Director with a copy of the estimate. Based on the estimated amount of damages, any claim that falls within the jurisdiction of the County Court shall be honored, denied or compromised within six (6) months of the date of inspection. All other claims shall, after the initial inspection and estimate, be promptly and diligently processed to a conclusion.
